Deputy Charged with Assaulting Handcuffed Inmate Fired

( Cincinnati ) - THe Hamilton County Sheriff's deputy accused of kicking a prisoner in the head is no longer employed by the department.

Sheriff Jim Neil announced on Wednesday that he has fired Sergeant Jesse Franklin for using excessive force. The incident that was captured on video happened while an OVI suspect was being booked into the Justice Center in early June. Investigators say Nicholas Ballachino, while handcuffed, resisted officers and bit Sgt Franklin on the boot. Franklin allegedly responded by kicking him in the head with his other booted foot. In addition to being fired, Franklin has been charged with misdemeanor assault.

He had been employed by the sheriff's office for the past 14 years.
