Ray Tensing Retrial Day One

( CINCINNATI, OH ) -- After opening arguments from the prosecution and defense, the new jury in the retrial of Ray Tensing saw the body cam footage of Ray Tensing's encounter in July 2015 with Sam Dubose.

While the video was playing, Tensing looked around the room quite a bit, and when it got to the part where he shot and killed Dubose, Tensing closed his eyes and put his head down.

Ray Tensing on day one of his retrialOne witness called to testify today had also testified in the first trial. UC Officer Philip Kidd arrived on the scene just before Ray Tensing shot Sam Dubose and was walking from his car to Tensing when the incident occurred.

Officer Kidd said that while on the scene, when Tensing said he dragged by Dubose's car, Kidd said "Yes, I saw that," he really did not see that happen. In court, Kidd said that he saw Tensing moving with the vehicle, so it was entirely possible that he was dragged and Officer Kidd did not want to argue with Ray Tensing there on the scene.

Officer Kidd also testified that while walking up to the car of Sam Dubose, he saw the car start to move away from the curb, he heard tires squeal, and only then did he hear the shot of Ray Tensing's gun as he shot Dubose in the head. He then says that he saw Tensing fall and then stand up again quickly before heading towards where Dubose's vehicle came to a stop.

In Officer Kidd's body cam video, which does not start until they are at Dubose's vehicle, Kidd can be heard telling Ray Tensing "Don't say anything." When asked why he said that, Kidd said "I don't know."

The retrial of Ray Tensing continues on June 9 at 9:30AM.
